Questions
Questions about a work injury claim
Plain answers to what clients ask most. The rules differ from place to place, so treat these as a starting point and call us about yours.
What should I do first after I'm hurt?
Get medical care, and tell your employer in writing that you were hurt at work. Keep a copy of what you send.
Is there a deadline?
Yes, more than one. Reporting the injury has a deadline and filing the claim has another, and both are shorter than most people expect.
Do I have to see the company's doctor?
That depends on the rules where you work and on your employer's plan. Call before you change doctors.
The insurer wants a recorded statement. Should I give one?
Talk to a lawyer first. A statement given in pain, on the phone, can be quoted back to you later.
Can I be fired for filing a claim?
Punishing a worker for filing is generally against the law. If it's happened, it may be a claim of its own.
Can I do light duty?
If your doctor allows it and the work fits your restrictions. Turning down suitable light duty can affect your benefits, so ask us before you decide.
How are you paid?
Our fee is a percentage of the benefits or settlement we recover for you, set out in a written agreement before we start. If nothing is recovered, you owe no attorney fee. Case costs, such as medical records and doctors' reports, are separate, and the agreement says how they're paid, including when there's no recovery.
Can we meet by video?
Yes. Many first meetings happen by video while a client is recovering at home.
Will I have one lawyer?
Yes. One of the three of us is on your claim from the start, and the other two know it too.
A question we didn't answer here?
Ask it on the phone. It costs nothing to call.
Please don't send confidential details until we've spoken.
