Disability benefits

Disability benefits after a work injury

Some injuries heal. Some leave you unable to do the job you had, or any job. Comp has benefits for both, and they're the ones insurers contest hardest.

Temporary, partial, permanent

While you recover, wage-loss benefits replace part of your pay. When your doctor says you've improved as much as you will, the question becomes what the injury took from you for good, and how much that's worth. The answer depends on medical ratings, your work history and the rules where you work.

When you can't go back to your trade

If the injury ends the work you trained for, there may be benefits for retraining, job placement or a lower-paying job. We build the record for those alongside the medical side, so neither waits on the other.

Social Security and private disability

A long-term injury can mean a Social Security disability claim, or a claim under a disability policy from work. We'll tell you how those fit with comp, and where offsets apply.

Sample matters

Two claims for lasting harm

  • Permanent benefits

    Lung condition, welder

Permanent disability benefits granted, with retraining approved alongside them.

    2023

  • $38,500

    Settlement, hand injury, press operator

Settled after the treating surgeon's rating, with future care for the hand kept open.

    2024

Sample matters, for the firm to replace with its own. Every claim turns on its own facts, and past results don't guarantee a similar outcome.

Questions about disability benefits

Should I settle my claim?

Sometimes it's the right choice, and sometimes it closes off care you'll need later. We'll go through what a settlement gives up before you decide. It's your decision.

The insurer's doctor says I can work. Now what?

That exam is one opinion. Your own doctor's view, your job's real demands and a second opinion can all answer it.

Can I get Social Security disability and comp at the same time?

In many cases, yes, though one may reduce the other. We'll show you how the numbers fit.
